To ensure a transparent and fair business relationship, we have drawn up these General Terms and Conditions (GTC). They govern the conclusion of the contract, delivery, terms of payment and all other essential aspects of our co-operation.

 

Please read the GTC carefully before placing an order with us. By placing an order, you agree to the following terms and conditions. If you have any questions or queries, please do not hesitate to contact us at any time.

1.Conclusion of contract and ordering process


1.1 Conclusion of the contract
The contract between Kent Leuchten and the buyer is concluded with the confirmation of the order by e-mail. This confirmation contains all essential details of the order, including articles, prices and, if applicable, individual specifications.

 

 

1.2 Verification of the order details
Buyers are requested to carefully check all confirmations or invoices received from Kent Leuchten for errors. If discrepancies or input errors are found, the buyer has the opportunity to contact Kent Leuchten by e-mail (serap@kentleuchten.com) or telephone (+49 178 405 3043) within 1-2 days of receipt of the order confirmation in order to correct them.

 

 

1.3 Customised products and individual orders
As all products are manufactured specifically for the customer, no changes or cancellations of the order can be made after the 1-2 day review period has expired.

 

 

1.4 Reservation of realisability
Kent Leuchten reserves the right to cancel orders if they are not technically or logistically feasible. In such a case, the buyer will be informed immediately and any payments already made will be refunded in full.

 

 

1.5 Availability of materials
The order confirmation does not constitute a guarantee for the availability of the required materials. Should there be delays or changes due to material shortages, the buyer will be informed in good time in order to find a solution.

2.Prices and terms of payment

2.1 Prices
All prices quoted on the website are in euros (€) and include VAT. Additional shipping costs or fees incurred for special projects or deliveries will be shown separately before the order is finalised.

 

 

2.2 Offers and changes
Kent Leuchten reserves the right to change prices at any time. The price displayed at the time of the order shall apply to the buyer, unless otherwise stated in the order confirmation. Unless otherwise stated, offers are subject to change and non-binding.

 

 

2.3 Payment methods
Payment can be made using the payment methods specified on the website, e.g:

The available payment methods may vary depending on the region or order.

 

 

2.4 Due date and delay
Unless otherwise agreed, the invoice amount is due immediately upon completion of the order. In the event of late payment, Kent Leuchten reserves the right to charge interest on arrears in accordance with the statutory provisions.

 

 

2.5 Individual agreements for customised products
An advance payment or deposit may be required for customised products. The amount and due date of the payment will be communicated to the buyer before the contract is concluded.

 

 

2.6 Securing the payment
Kent Leuchten reserves the right to cancel the order if payment is not received on time or the selected payment method is not successfully executed.

 

 

2.7 Incorrect price information
If a product is incorrectly priced due to a technical error or typographical error, Kent Leuchten reserves the right to cancel the order. In such a case, the buyer will be informed immediately and any payments already made will be refunded.

3.Terms of delivery

3.1 General terms of delivery
Kent Leuchten is responsible for delivering the ordered products in perfect condition, complete and in accordance with the specifications stated in the order. Delivery shall be made to the address specified by the buyer. Buyers are obliged to carefully check the delivery details provided and ensure that they are correct and complete.

 

 

3.2 Delivery time and delays
The delivery time is usually 2-3 weeks from order confirmation. The delivery time may vary for larger order quantities or special projects. Should unforeseen delays occur, Kent Leuchten will inform the buyer immediately. Kent Leuchten is not liable for delays in delivery caused by external circumstances such as natural disasters, strikes or delays by the freight company.

 

 

3.3 Delivery to other addresses/persons
At the request of the buyer, delivery can be made to another person or organisation. The recipient must identify himself by presenting a valid identity document. In the event of delivery to a different address, Kent Leuchten shall not be liable for incorrect information provided by the buyer.

 

 

3.4 Problems during delivery
Buyers should check the parcel for external damage upon receipt. In the event of visible damage, acceptance should be refused and a report drawn up with the delivery service. If the parcel has been accepted and damage or defects are only discovered later, Kent Leuchten must be notified in writing within one working day. Photos of the damage and the packaging should also be sent. Without such notification within the deadline, the product shall be deemed to have been delivered in accordance with the contract.

 

 

3.5 End of the delivery obligation
The delivery obligation of Kent Leuchten ends with the delivery of the product to the specified address and acceptance by the buyer or an authorised person.

 

 

3.6 Shipping costs
As a rule, Kent Leuchten shall bear the shipping costs. Special shipping guidelines apply for deliveries outside Germany. In such cases, the shipping costs may be borne by the buyer. These will be communicated individually before the order is finalised.

4 Retention of title

The delivered goods shall remain our property until the purchase price and all associated costs have been paid in full. You are obliged to treat the goods in perfect condition until full payment has been made. Should you resell the goods before full payment has been made, we shall retain title to the goods and you hereby assign to us all claims arising from the resale of the goods. We reserve the right to reclaim the goods in the event of late payment or delayed delivery.

5. right of cancellation
You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period begins on the day on which you or a third party named by you, who is not the transport service provider, took or has taken possession of the last goods.


Important: Our voluntary right of return is excluded if the goods were customised according to your wishes.

 

In some cases, a cancellation can only be made with our prior consent.

by means of a clear declaration (e.g. by post or e-mail) of your decision to cancel the contract. You can use our sample cancellation form for this purpose, but this is not obligatory. If you make use of this option, we will immediately send you a confirmation of cancellation by e-mail.

 

To meet the cancellation deadline, it is sufficient for you to send us your declaration of cancellation within the deadline.

 

 

Consequences of cancellation
If you cancel the contract, we will refund all payments we have received from you, including the shipping costs (with the exception of the additional costs incurred by the choice of a shipping method other than the standard delivery offered by us), but at the latest within fourteen days of receipt of your cancellation.

 

The refund will be made using the same means of payment that you used for the original transaction, unless expressly agreed otherwise. Under no circumstances will you incur any costs as a result of the refund.

 

However, we may withhold the refund until we have received the returned goods or you have provided proof of dispatch, whichever occurs first.

 

You are obliged to return or hand over the goods to us within fourteen days of notification of cancellation. The deadline is deemed to have been met if you dispatch the goods within the fourteen-day period. We will bear the costs of returning the goods.

 

You only have to pay for any loss in value of the goods if this loss is due to improper handling that goes beyond a normal inspection of the goods.

 

Exceptions to the right of cancellation
There are legal exceptions to the right of cancellation, which we reserve the right to assert against you. In particular, the right of cancellation does not apply to goods that are manufactured according to your specifications or clearly tailored to your personal needs.

6 Warranty and liability

6.1 Warranty
The statutory warranty rights apply to the handmade products. The warranty covers the repair or replacement of defective products.

 

6.2 Liability
Kent Leuchten shall only be liable for damage caused by gross negligence or intent. Liability for indirect damage or consequential damage is excluded.

7.Data protection

7.1 Data protection
Kent Leuchten collects, processes and stores personal data in accordance with the General Data Protection Regulation (GDPR). Further information can be found in our privacy policy on our website.

8. dispute resolution

8.1 Consumer dispute resolution
We always endeavour to resolve any conflicts and disputes with our customers amicably. Should a dispute nevertheless arise, we are obliged to refer to mediation by a consumer arbitration board.

The European Commission provides a platform for online dispute resolution (ODR platform), which you can access via the following link

The ODR platform serves as a central point of contact for the out-of-court settlement of disputes arising from online contracts between consumers and companies.

 

8.2 Participation in a dispute resolution procedure
In principle, we are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

 

 

8.3 Place of jurisdiction
The statutory place of jurisdiction applies to disputes in connection with contracts between us and our customers. If the customer is a consumer, the place of jurisdiction shall be the customer's place of residence. In the case of merchants or legal entities under public law, the place of jurisdiction shall be the registered office of Kent Leuchten e.K..

9. final provisions

9.1 Applicable law: The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

 

9.2 Severability clause: Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
